1. Acceptance of Terms

By accessing or using the PGY-3 Chiefs Community Platform ("Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

2. Description of Service

The PGY-3 Chiefs Community Platform is a web-based service designed to:

• Connect Internal Medicine residency programs with PGY-3 Chief Residents
• Facilitate resource sharing and collaboration
• Build a research database of programs with PGY-3 CRs
• Provide educational content and updates through our blog
• Enable professional networking among users

3. Eligibility

To use the Platform, you must:

• Be at least 18 years of age
• Be a medical professional (PGY-3 Chief Resident, Program Director, GME Administrator, or related role)
• Be affiliated with an Internal Medicine residency program
• Provide accurate and complete registration information
• Agree to these Terms and our Privacy Policy

4. Account Registration and Security

4.1 Account Creation

You must create an account to access most Platform features. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4.2 Account Approval

All accounts require administrator approval before full Platform access is granted. We reserve the right to approve or deny any account registration at our sole discretion.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use the Platform for:

• Professional networking and collaboration
• Sharing and accessing educational resources
• Contributing to the community through blog comments and discussions
• Participating in research studies (voluntary)
• Educational and academic purposes

5.2 Prohibited Uses

You agree NOT to:

• Upload, post, or share any Protected Health Information (PHI) or patient data
• Violate any applicable laws, regulations, or third-party rights
• Impersonate any person or entity or falsely state your affiliation
• Transmit spam, chain letters, or unsolicited mass communications
• Upload viruses, malware, or any malicious code
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Interfere with or disrupt the Platform's operation
• Harvest or collect information about users without their consent
• Use the Platform for commercial purposes without permission
• Upload content that is defamatory, obscene, offensive, or infringes on intellectual property rights

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you upload or post ("Your Content"). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute Your Content on the Platform and for research purposes.

6.2 Platform Content

The Platform's software, design, text, graphics, and other content (excluding user-generated content) are owned by or licensed to us and protected by intellectual property laws. The Platform software is licensed under the MIT License (see GitHub repository).

6.3 Resource Sharing

Resources uploaded to the Platform are shared with other users. By uploading resources, you represent that:

• You have the right to share the content
• The content does not infringe on third-party rights
• The content is appropriate for educational and professional use
• The content does not contain PHI or confidential information

7. Research Participation

The Platform is used to collect data for research on PGY-3 Chief Resident programs. By registering, you consent to:

• Inclusion of your program information in anonymized aggregate statistics
• Potential contact for voluntary research surveys (you can opt-out at any time)

Survey participation is completely voluntary. You may decline any research participation without affecting your Platform access.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.

9. Disclaimers and Limitations of Liability

9.1 No Medical Advice

The Platform is for professional networking and educational purposes only. It does not provide medical advice, diagnosis, or treatment recommendations.

9.2 "As-Is" Service

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.3 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Platform
• Unauthorized access to your account or data
• Any content or conduct of third parties on the Platform
• Any interruption or cessation of the Platform

10. Indemnification

You agree to indemnify, defend, and hold harmless the Platform, its operators, administrators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your Content

11. Termination

11.1 By You

You may terminate your account at any time by contacting us at contact@pgy3chiefs.org.

11.2 By Us

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Any reason at our sole discretion

12. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting a notice on the Platform or sending an email. Your continued use of the Platform after such notification constitutes acceptance of the modified Terms.

13. Changes to the Platform

We reserve the right to modify, suspend, or discontinue the Platform (or any part thereof) at any time, with or without notice. We shall not be liable for any modification, suspension, or discontinuation of the Platform.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding your use of the Platform and supersede all prior agreements and understandings.
